Legal Victory: Charter 2(d) Right to Associate Lawsuit Proceeds After Motion to Dismiss Denied

A monumental victory for the freedom movement.

On January 2 2025, with impressive efficiency, Justice Southcott of the Vancouver Federal Court rendered a precedent setting decision in Canada.  The class action 2(d) Charter claim, which was filed on October 6, 2023, has survived the Attorney General of Canada’s motion to strike and will proceed to class certification. The claim was brought on behalf of three plaintiffs, STACEY HELENA PAYNE, JOHN HARVEY and LUCAS DIAZ MOLARO, all of whom are members of FedsForFreedom, a group with the mandate of advocating for employees rights to informed consent, bodily autonomy, and medical privacy within the Canadian Federal Public Service. 

Southcott noted “the class action is still some distance from being certified, and the parties have yet to begin litigating in detail which employees might be covered in the class definition”.  

As expected the Attorney General has filed an appeal which will further prolong the process, thereby inflating costs. Should the decision to proceed be upheld in the court of appeals, the next step in the process will be the proposed representative plaintiffs achieving class certification wherein it must be demonstrated that all criteria are met. In order to do that, the proposed representative plaintiffs must show to the Court that they have the ability to see this through to the end; meaning, in large part that, they possess the financial means to fund the case.

Once certified, all Canadians who meet the (court determined) class definitions can be included in the Class Action at no cost to them. 

Legal counsel, expert witnesses, administrative and court fees all require significant funds.  We are striving to support the proposed representative plaintiffs through our fundraising efforts.
